Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Robyn ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app. These Terms constitute a legal agreement between you and HelloButter Inc ("we", "us", or "our").

2. Description of Service

Robyn is a desktop application for macOS that functions as a personal AI assistant. The app integrates with third-party services (including Google Gmail, Google Calendar, Google Contacts, WhatsApp, Telegram, iMessage, Telnyx, ElevenLabs, Cal.com, Todoist, and AI providers) to provide a unified communication and productivity experience. Robyn runs locally on your Mac and stores your data locally.

3. Account Registration

To use Robyn, you must create an account using Apple Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 13 years of age to use Robyn. By creating an account, you represent that you are at least 13 years old.

4. Subscription and Payment

Robyn may offer paid subscription plans. By subscribing, you agree to pay the fees associated with your selected plan. Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the renewal date.

• We reserve the right to change pricing with 30 days' notice to existing subscribers

5. Third-Party Services

Robyn integrates with third-party services that have their own terms and conditions. By connecting these services through Robyn, you acknowledge that:

• You are responsible for complying with the terms of each third-party service you connect
• We are not responsible for the availability, accuracy, or conduct of third-party services
• Your use of Google services through Robyn is subject to Google's Terms of Service
• AI-generated content (summaries, drafts, briefings) is provided as-is and may contain errors — you are responsible for reviewing AI output before acting on it

6. Acceptable Use

You agree not to use Robyn to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or bulk communications
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the app's functionality
• Reverse engineer, decompile, or disassemble the app
• Use the app for any purpose that violates the terms of connected third-party services

7. AI Voice Agents and Phone Numbers

If you use Robyn's AI voice agent and phone number features:

• Phone numbers are provisioned through Telnyx and subject to their terms of service
• You are responsible for complying with all applicable telecommunications regulations, including TCPA and local calling laws
• AI voice agents must not be used for robocalling, telemarketing fraud, or impersonation
• You must disclose to callers that they are speaking with an AI agent where required by law
• Phone numbers may be reclaimed if your subscription lapses or if used in violation of these Terms

8. Intellectual Property

Robyn and its original content, features, and functionality are owned by HelloButter Inc and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal or business purposes in accordance with these Terms.

Your data remains yours. We do not claim ownership of any content you create, store, or process through Robyn.

9. Privacy

Your use of Robyn is also governed by our Privacy Policy, which describes how we handle your data. By using Robyn, you consent to the data practices described in the Privacy Policy.

10. Disclaimer of Warranties

Robyn is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The app will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, complete, or reliable
• Third-party service integrations will always be available
• The app will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by law, HelloButter Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of Robyn.

Our total liability for any claims arising from your use of the app shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless HelloButter Inc from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the app, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to Robyn at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination:

• Your right to use the app ceases immediately
• Your locally stored data remains on your Mac and is not affected
• Any active phone numbers may be released
• You may request a refund for any unused portion of a prepaid subscription

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. If we make material changes, we will provide notice through the app. Your continued use of Robyn after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Robyn shall be resolved in the courts located in Delaware.
